Business Mediation
Protecting partnerships, contracts, and company value without litigation.
Description
Business Mediation is best for business owners, partners, executives, and vendors facing contract disputes, ownership breakups, or service disagreements. It focuses on win-win outcomes that allow long-term business partnerships to survive. Disputes may be solved in days or weeks rather than with months or years of court litigation. Solutions can be tailored for practical business needs, cash-flow realities, and long-term strategy.
Mediation Stages
Stage 1: Introduction & Guidelines
The mediator introduces the goals and ground rules for the mediation process.
Stage 2: Information Gathering and Clarifying
Each party shares their perspective on the conflict. The mediator facilitates discussion, asks clarifying questions, and identifies common ground.
Stage 3: Listing Topics
Topics are the things the parties would like to make solutions for. The mediator lists the topics identified in Stage 2. Once both parties confirm the topics accurately reflect what needs to be resolved, the process moves forward.
Stage 4: Brainstorming
Parties brainstorm solutions for each topic, select mutually agreeable ideas, and work through the details to make them practical.
Stage 5: Plan Finalization & Signing
The parties decide if they want a verbal or written agreement. If the parties want the agreement written, the mediator drafts a summary for both parties to review, sign, and keep, which may serve as a legally binding contract.
